I MIGHT hold a hotel criminally liable for a prostitute who hangs out in the lobby, handing out flyers to advertise her services, IF the hotel appeared to support it - since those services are still illegal in most places. That's the current state of the law under Section 230 of the CDA, which is intended to amend - right now, websites aren't liable for illegal posts unless they demonstrate approval by their actions.

@ToplessNewYork I am not arguing your point but could it not be said that if the websites allow said posts to remain on their site that is by admission them approving of it?

@Caia Under current law, a website is deemed to give tacit approval only if they're NOTIFIED of the post's existence AND they don't take steps to rectify the situation in a timely fashion. The mere fact that a post exists can't be used as evidence of approval - at least not under current Section 230, pre-FOSTA.
